2018-C.4 AMENDMENT TO INCREASE THE SIZE OF THE DISCIPLINARY BOARD The President of the Disciplinary Board has asked the Committee to provide an amendment that increases the size of the Disciplinary Board. The current seven-member Disciplinary Board does not have sufficient members to perform its duties without overtaxing the board’s membership, particularly in the event the Diocese has more than one Title IV case proceeding at the same time. After deliberations, the Committee agreed to recommend that Canon 27, Section 2 be amended as set forth in Exhibit D attached hereto. Each of the seven (7) members currently serving on the Disciplinary Board are elected by the Convention. During the drafting process, the Committee discussed various options by which the additional six (6) members could be added. The Committee ultimately determined that a provision directing the Bishop to appoint the additional six (6) members of the Disciplinary Board would a) allow the Disciplinary Board to add new members promptly; and b) increase the number of potential members. The Committee believes that the proposed amendment is consistent with the Constitution of the Diocese of Southwestern Virginia, the existing Canons, the Proposed Canons, and recommends its adoption. 2018-C.5 TECHNICAL MODIFICATIONS IN THE EVENT THAT THE CONVENTION DOES NOT ADOPT THE PROPOSED CANONS A. In the event that the Convention does not adopt the Proposed Canons, the amendment set forth in Proposal II (in the form and substance approved by the Convention), shall replace Canon 24, Section 4(c) of the existing Canons. B. In the event that the Convention does not adopt the Proposed Canons, Proposed Canon 17, as set forth in Proposal III (in the form and substance approved by the Convention), shall be inserted as new Canon 16A of the existing Canons. C. In the event that the Convention does not adopt the Proposed Canons, the corresponding changes set forth Proposal IV (in the form and substance approved by the Convention) shall be made to Canon 27, Sections 2 and 3. * * * It has been my privilege and pleasure to serve with the distinguished members of this Committee.
